§ 2-567. Criteria and standards for payment of public funds for specific public purposes.

  • (a)

    Public purposes. The following purposes are determined to be public purposes which qualify for the expenditure of city funds:

    (1)

    Promotion of education, arts and culture within the city.

    (2)

    Promotion and preservation of the city's history and the providing of education pertaining to the history of the city.

    (3)

    Promotion and preservation of local and national civic pride through traditional Fourth of July parades and other similar celebrations within the city.

    (4)

    Assistance to economically disadvantaged individuals.

    (5)

    Public relations for the promotion of the city.

    (b)

    Standards for qualification to receive public funds. In order to be eligible to receive public funds, the recipient must meet the following criteria:

    (1)

    Be organized and exist as a not-for-profit corporation, association, organization, or be qualified pursuant to the provisions of Section 501(c)(3) of the United States Internal Revenue Code.

    (2)

    Have a corporate charter or bylaws which recite that the primary purpose of the entity is to promote and advance a charitable, civic, historical, cultural or other socially beneficial service, and, in fact, actually promote such service on a regular basis.

    (3)

    Have its principal place of business and regular meetings within the city.

    (4)

    Funds to be utilized only within the corporate limits of the city.

    (5)

    Recipient shall file with the city clerk, by May 1 following the receipt of funds, a report indicating how the funds were utilized.

    (c)

    Application for public funds. Any entity meeting the criteria and standards provided for in this section may apply to the city for receipt of public funds by completing the application customarily in force and effect at the city and filing the application with the office of the city manager. Said applications shall be filed by August 1 of each year for funding consideration in the city's next fiscal year.

    (d)

    City determination of eligibility. Upon receipt of an application for public funds, the city shall either reject the application, schedule an interview with a representative of the applicant or further consider the application during a city council meeting. The determination of whether to pay public funds to the applicant shall rest in the sole discretion of the city.
